Draft Rules on Industrial Relation

The Himachal Pradesh Government, vide notification No. Shram (A)3-5/2021, dated 29th September 2021, has notified its draft on Himachal Pradesh Industrial Relations Rules, 2021. When this rule will become effective, it will supersede The Himachal Pradesh Industrial Disputes Rules, 1974; The Industrial Employment (Standing Orders) Himachal Pradesh Rules, 1973; and, The Himachal Pradesh Trade Unions Regulation, 1978. Objections and suggestions may be reported in writing to the Labour Commissioner, Himachal Pradesh, Director of Labour & Employment, within a period of 30 days from the date of publication of this notification.

Delhi

Advise on Payment of Bonus

The Government of Delhi (Labour Department) has published an advisory bearing No. F.No.15.(46)/Lab/2020/4175, dated 14th October 2021, advising all the private establishments and the Government establishments on the payment of bonus to the workers engaged through contractors.

This advice has been given by the Delhi Labour Department in the light of various complaints received from the outsourced workers regarding non-payment of bonus. The Labour Department has highlighted some of the provisions of Payment of Bonus Act, 1965 which mandates every establishment employing 20 or more employees to pay bonus to their employees within eight months of the close of the accounting year. However, all the contractors/ establishments have been advised to pay the bonus to their employees by forthcoming Deepawali festival as a part of customary process. In case of any default, the employers/ contractors will be liable for prosecution and the bonus due will be recovered as the arrears of land revenue. Attention to the Principal Employers also drawn to the provisions of the Contract Labour (Regulation & Abolition) Act, 1970 which makes Principal Employer liable to ensure compliance of the various labour laws including Payment of Bonus Act, by the respective contract labour/ contractor.

Maharashtra

Sexual Harassment of Women at Workplace (POSH Rules)

The Bombay High Court, in order to protect the identity of the parties, has issued some important guidelines which should be followed while conducting proceedings for the matters related to sexual harassment of women at workplace.

The guidelines are as follows:

• The matters will be heard either in-camera or in judge’s chamber.

• Orders are not to be passed in the open court and should not be uploaded on the official High Court website.

• The media is barred from publishing the proceedings or reporting of judgment without the court’s permission.

• Both sides and all the parties, and advocates, and also the witnesses are forbidden from disclosing the contents of any order, filing of judgment, etc. to the media or publishing any such material in any mode or fashion by any means, including social media without specific permission from the court.

• In all orders, the endeavour will be to anonymize the identities of the parties.

• In the order sheets, the names of the parties will not be mentioned. The orders will be read “A v B”, “P v D”, etc.

• In the body of the Order, the parties will not be referred to by their names but only as plaintiff, defendant No. 1, etc.

• In the body of any Order, there will be no mention of any personally identifiable information (PII), such as email ids, mobile or telephone numbers, address, etc.

• No witness’s name will be mentioned, nor will their address be noted.

• Orders/ judgments on merits will not be uploaded.

• The record is not to be digitized by any third-party solution provider without an order of the court. If the record is to be digitised, directions will be sought from the court for supervised digitisation.

• All the orders and judgments will be delivered in private, that is to say, not pronounced in open court but only in chambers or in-camera.

• If any Order is to be released into the public domain, this will require a specific order of the court with the condition that only the fully anonymised version of the order of judgment maybe considered in public domain for publication.

• The registrar will not permit anyone other than the Advocate-on-record with a current and valid vakalatnama to take inspection or copies of any filing or order.

• The entire record is to be kept sealed and is not to be given to any person without an order of the court.

• Witness depositions will not be uploaded in any circumstances.

• No online or hybrid facilities for hearing.

• Only the advocates and the litigants are permitted to attend the hearings. Even the support staff (clerks, peons, etc.) must leave the court.

• Except the Court Master/ Associate or Sheristedar and the stenographer or person providing secretarial assistance, other court staff must also leave the court and not be present at the hearing.

• Witness to the action, in addition to the usual oath, must sign a statement of non-disclosure and confidentiality.

It will continue to apply where that information about the parties have been obtained by using the contents of a judgment or order to discover information already in the public domain.

All persons, including the media, are required to ensure strict compliance with these conditions of anonymity. Failure to do so will be a contempt of court and it may invoke further penal provisions and actions.

Gujarat

Code on Wages Rules, 2021

The Government of Gujarat, vide notification No. KHR/2021/128/LVD/10/2020/ 555709/M(2), dated, 5th October 2021, has finalised its Code on Wages (Gujarat) Rules, 2021. This Rules will supersede The Payment of Wages (Procedure) Rules, 1937; The Gujarat Payment of Wages Rules, 1963; The Gujarat Payment of Wages (Unclaimed Amounts) Rules, 1963; The Gujarat Payment of Wages (deductions for national Defence Fund and Defence Savings Scheme) Rules, 1964; The Payment of Wages (Manner of Recovery of Excess deductions) Rules, 1967; The Gujarat Minimum Wages Rules, 1961; and The ease of Compliance to Maintain Registers under various Labour Laws (Gujarat) Rules, 2017.

Note: Though the final Rules been published, however, it will be effective once The Code on Wages, 2019, which is in draft stage yet, becomes effective.

The salient features of the Rules are as follows.

• Inspector will be renamed as Inspector-cum-Facilitator.

• Spread-over time will be 12 hours.

• Weekly-off can be substituted with compensatory off, but, employee should not be working for more than 10 days consecutively, without rest for whole day. Also, employees may be given substituted rest day before or after 5 days of the weekly-off day when he will be present.

• If an employee works on his rest day, such employee should be paid wages at overtime rate and should be given a substituted rest day.

• If an employee works on night-shift, next whole day should be given as rest day for such employee.

• For emergency work and for employees whose employment is essentially intermittent, some exemptions are given in working hours, provided spread-over hours should not be extending more than 16 hours and actual working hours should not extend beyond 9 hours.

• The total recovery/ deduction in a month should not be more than 50 percent of the monthly wages.

• Notice of fines should be displayed in the establishment and a copy of the notice should be sent to the Inspector-cum-Facilitator. Approval should be taken from the Assistant Commissioner of Labour before imposing the fine on the employees.

• Deduction for Absence should be intimated to the Inspector-cum-Facilitator within 10 days from the date of such deduction, if deductions from employee is more than one wage-period or if relates to prescribed condition related to strike.

• When making deduction for damages or loss, explanation should be given to the concerned employee in person and in writing and opportunity should be given to offer their explanation. Intimation should be given to the employee within 15 days from the date of such deduction.

• Deductions for recovery of loans and levy of interests on the same should be as per the Government regulations.

• If any amount payable to an employee is due after his death or his whereabouts not being known and the amount could not be paid to the nominee of the employee, then after the expiry of three months from the date when it became due should be deposited with the Labour Welfare Commissioner or the Assistant Commissioner of Labour who will disburse the same to the nominee. Labour Welfare Commissioner or the Assistant Commissioner of Labour will need to settle the same to nominees/ heirs, etc. within two months.

• If any amount payable to an employee remains undisbursed because of no nomination or for any other reason, such amount should be deposited with the Labour Welfare Commissioner/ Assistant Commissioner of Labour within 15 days after the expiry of six months from the date when the amount has become payable.

• All fines, deductions, all realisation shall be recorded in a Register Form –I.

• If there is any claim by the employees for which the employer has failed to comply, then the employee or the Trade Union can make an application for the same to the authority in Form-II.

• Muster Roll and Wages Register will be in Form – IV

• Wage Slips should be issued to the Employees within 5 working days of making the payment of wages in Form – V

• The principal employer should pay to its labour contractor the amount payable to contract employees before the date of payment, in order to pay the wages by 7th of the succeeding month.

• If the labour contractor has failed to pay the minimum bonus to his employees, then the principal employer will be liable to pay such payment to the employees only upon the receipt of written information of such failure from the employee or the Trade Union.

Goa

Shops and Establishments Act

The Government of Goa including Daman and Diu, vide notification No. 7/31/2021-LA, dated 24th September 2021, has passed bill and proposed following amendments published for the general information of the public under the Goa Shops and Establishments Act, 1973.

• In the Definition of “Employee” which includes dependent relative of an employer or his partner, who is living with and depending upon such employer or partner” shall be omitted.

• The Inspector shall, within the period of seven working days from the date of receipt of the application and the fees, have to register/renew the registration of the Establishment, and an electronic certificate of renewal shall be auto-generated.

• If the Inspector fails to register or renew the registration of the Establishment within seven days, such establishment shall be deemed to have been registered / renewed under this Act.

• If the application for renewal of Registration Certificate is not made 30 days before its expiry, the employer may have to pay the penalty not exceeding 25 percent of the registration fees.

• Bank or the financial institution can apply for Registration Certificate for more than a year.

• Women employees can be allowed to work in night after providing adequate facilities and protection to the women employees.

• Provisions have been made to keep all the Registers and Forms in electronic format, but should be produced in hard copy to the Inspector on his demand.

• For the applicability of the provisions of the Act, the salary threshold limit of an employee under any establishments under Section 61, has been enhanced from Rs. 6,500/- to Rs. 24, 000/-.

The penal provisions have been amended as per the violation up to Rs. 50,000/- followed by the compounding of offenses.

Himachal Pradesh

Regulation of Employment and Conditions of Service

The Government of Himachal Pradesh, vide notification No. Shram(A) 3-9/2021, dated 24th September 2021, has amended the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008. This amendment has brought more clarity on the financial assistance which can be availed by the beneficiaries and also added some of the benefits which were not available in the earlier Rule. Other than the educational assistance, marriage assistance, family pension which were available in the earlier Rule, Government has also added some of the benefits such as Female Birth Gift Scheme, Mentally Retarded Children Benefit Scheme, Widow Pension, Hostel Facility Scheme, Mukhyamantri Awas Yojna.

Tamil Nadu

Election Holiday

The Tamil Nadu Government, vide Order NO G.O. (Ms) No.121, dated 28th September 2021, has declared 6th October 2021 (Wednesday) and 9th October 2021 (Saturday) as paid holidays to every person employed in any business, trade, industrial undertaking or any other establishments who are entitled to cast vote in their respective Rural Local Body election.

The election will take place in two phases on 6th and 9th of October 2021 in nine newly reconstituted districts - Kancheepuram, Chengalpattu, Vellore, Ranipet, Tirupathur, Villupuram, Kallakuruchi, Tirunelveli, and Tenkasi. Also, Casual Election will be held in 28 other districts on 9th October 2021.

This Rule may not apply to any elector whose absence may cause danger or substantial loss in respect of employment in which he is engaged.

EPFO Services in UMANG and DigiLocker

The UMANG (Unified Mobile Application for New Age Governance) and storage of data in DigiLocker app are the key initiatives introduced under the Digital India program to develop a common, unified platform and mobile app to facilitate a single point of access to all Government services. This application is available in Hindi, English and other languages. Services related to The Employees’ Provident Fund Organisation are also available on the App which can be used by the EPF members (i.e. employees) as well as the employers.

Following are some of the services which can be availed by using UMANG:

• Track claim status
• Activate UAN
• Download scheme certificate
• Submission of Jeevan Praman
• Download Pension Payment Order (PPO)
• Aadhaar seeding with the UAN
• Register and track grievances
• Search Establishment(s)
• Employers can also view remittance details and TRRN status

DigiLocker is a secure cloud-based platform for storing, sharing, and verifying documents/ certificates such as UAN Card, Pension Payment Order (PPO) and Scheme Certificates, etc. All documents can be downloaded and kept in DigiLocker app. This may eliminate the need for physical documents in future.

Manipur

Extension of ESIC provisions to Local Bodies

The Manipur Government, vide Notification No. LAB-1/3/2020-LAB and EM-LAB&EMPL, dated 20th September 2021, has extended the provisions of Employees’ State Insurance Act, 1948, to Municipal Corporations, Municipal Boards, Municipal Councils, and other Local bodies controlled by the State Government in all the areas of Manipur where the provisions of ESIC Act are already in force.

Code on Wages Rules

The Government of Goa, vide notification No. 24/16/2021-LAB/444, dated 23rd September 2021, has notified its Draft Rule on The Goa Code on Wages Rules, 2021. Draft of the said rules will be taken into consideration by the government on the expiry of 45 days from the date of publication of this Notification. All objections and suggestions, if any, may be addressed to the Secretary (Labour), Government of Goa, Secretariat, Porvorim.

Delhi

Shops and Establishments Rules

The Delhi government, vide notification No. 15(52)/Lab/2021/3618-3626, dated 24th September 2021, has published its draft rules further to amend the Delhi Shops and Establishments Rules, 1954. The draft will be taken up for consideration after the expiry of a period of 15 days from the date of its publication. The objections and suggestions are invited and maybe sent to the Additional Secretary (Labour), C-Block, 5, Sham Nath Marg, Delhi-110054. Following changes will be applicable, if this draft rules come into effect:

• Application for registration will be online.
• On submission of application online, the Registration Certificate shall be generated online.
• For notifying any change in the information given to the Registering authority, the time period has been increased from 15 days to 30 days after the change has been taken place and this can be done online.
• Schedule I of the Shops and Establishments Rules, 1954, will be deleted, which speaks about the exemptions to certain establishments from the provisions of the said Rule.
• Schedule II of the Shops and Establishments Rules, 1954, will be deleted which speaks about certain employees who would be exempted from certain provisions of the said Rule.
• Form H & I will be deleted and Form “G” has been reformatted which can be referred in the attached notification.

Assam

Extension of ESIC provisions in certain parts of Assam

As per the Central Government notification No. S.O. 3964(E), dated 24th September 2021, the following provisions of the Employees’ State Insurance Act, 1948, in addition to the provisions which are already there in force, will come into effect in the entire areas of Baksa, Charaideo, Dima Hasao, Hailakandi, Hojai, and Kokrajhar districts in the State of Assam with effect from 1st October 2021, in addition to the already implemented area in the district. The following provisions have been added:

• Entire Chapter IV of the ESIC Act, 1948, which speaks about Contributions. However, Sections 44 and 45 of the same Chapter are already implemented by earlier notification.
• Entire Chapter V which speaks about Benefits.
• Chapter VI which speaks about adjudication of disputes and claims. However sub-section (1) of section 76 and sections 77, 78, 79, and 81 of the same Chapter are implemented by earlier notification.

Tripura

Implementation of ESIC provisions in certain parts of Tripura

The Ministry of Labour and Employment, vide notification No. S.O. 3952(E), dated 23rd September 2021, has notified the following provisions of The Employees’ State Insurance Act, 1948. These provisions shall come into force in all the areas of Dhalai, Gomati, North Tripura, and Sepahijala districts in the State of Tripura with effect from 1st October 2021.

Section 39 (all applicable members to contribute)
Section 40 (Principal employer to pay contributions in the first instance)
Section 41 (Recovery of contributions to be done by the immediate employer)
Section 42 (General provisions as to payment of contributions to be followed)
Section 43 (Method of payment of contributions to be followed for all applicable members)
Section 45A (Determination of contributions in certain cases to be done)
Section 45H (Application of certain provisions of the Income-Tax Act) of Chapter IV;
Section 46 (Benefits) to Section 73 (Employer not to dismiss or punish employee during period of sickness, etc.) of Chapter V; and
Section 74 (Constitution of Employees’ Insurance Court), section 75 (Matters to be decided by the Employees’ Insurance Court), Sub-sections (2) to (4) of section 76 (Institution of proceedings, etc.),
Section 80 (Benefits are not admissible unless claimed in time),
Section 82 (Appeal)
Section 83 (Stay of payment for pending appeal) of Chapter VI.

Delhi

Extension of deadline for seeding of AADHAAR with UAN

The Hon’ble High Court of Delhi has given an interim relief to employers by extending the period for seeding the Aadhaar number with UAN to 30th November 2021. Earlier, the EPFO had specified the deadline as 1st September 2021, after which the employers would not have been able to remit monthly PF and allied dues of their employees whose Aadhaar numbers are not seeded with UAN, and the employer would be liable for any legal/ statutory/ membership/ service delivery aspects affecting their employees.

The Hon’ble Court further directed the EPFO to not take any coercive action against the employer for late deposit of PF dues for wage month May 2021, if the PF contributions were remitted by the employer between 15th June 2021 to 20th June 2021 due to overnight change in EPF online software which had led to delay in remitting the contributions.

The Hon’ble court further directed the EPFO to appoint a Grievance Redressal Officer at the local level of EPFO offices to provide assistance to employers and to ensure that deposits are received irrespective of UAN being seeded with Aadhaar or not.

This Order from the Hon’ble Delhi High Court has come as a result of writ petition filed by Association of Industries and Institutions, Punjab Chapter challenging the EPFO circular, dated 1st June 2021.

This is an interim relief and the final order is awaited, which will decide about the validity of the Circular.

West Bengal

Election Holiday

The West Bengal Government, vide notification No. Labr/1676/(20)/(LC-IR)/IR/7S-06/17, dated- 13th September 2021, has made obligatory on the part of the employers of any business, trade, industrial undertaking or any other establishments of the areas under 56-Samserganj, 58-Jangipur Assembly Constituencies, and 159-Bhabanipur Assembly Constituency to grant paid holiday to the worker who are entitled to cast vote on account of election & bye-election for W.B Legislative Assembly from the said areas on 30th September 2021 (Thursday).
· If any employer contravenes this Rule, they will be punishable with fine, which may extend to 500 rupees.
· This rule shall not apply to any elector whose absence may cause danger or substantial loss in respect of the employment in which he is engaged.
· Paid holiday also should be given to an employee who is residing in the above said areas but working in any industrial undertaking which is not in the above said areas.
· The daily wage/casual workers are also entitled for a paid holiday.

Tamil Nadu

Labour Welfare Fund Act

A Bill further to Amend and Enhancement of LWF contributions.
The Tamil Nadu Government, vide its notification No. 399, dated 6th September 2021, introduced a Bill called the Tamil Nadu Labour Welfare Fund (Amendment) Act, 2021, where amendment has been proposed to enhance the yearly contributions to be paid to the Tamil Nadu Labour Welfare Fund by amending sub-section (1) of Section 15 of The Tamil Nadu Labour Welfare Fund Act, 1972. As per the new provision, every employee shall contribute a sum not exceeding fifty rupees (50 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund and every employer shall in respect of each such employee, contribute a sum not exceeding hundred rupees (100 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund and the Government shall, in respect of each such employee, contribute a sum not exceeding fifty rupees (50 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund.”
Earlier the said contributions were Rs.10, 20, and 10 respectively. The Bill seeks to give effect to the above decision.

Tamil Nadu

Shops & Establishments Act

A Bill on Amendment of Tamil Nadu Shops & Establishments Act. The Tamil Nadu Government, vide its notification No. 399, dated 6th September 2021, introduced a Bill called the Tamil Nadu Shops and Establishments (Amendment) Act, 2021 which has made certain amendments to the Tamil Nadu Shops & Establishment Act 1947.
After Section 22 of the Act, Section 22-A has been inserted, which makes it mandatory for all the employers to provide seating arrangements to all the employees to help them sit, which may require in the course of their work.
It was proposed earlier though not operationally initiated, on and from the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018, the employer of every establishment employing ten or more workers shall, within a period of six months from the date of commencement of his business, apply for registration and obtain a registration certificate, same to be initiated, and the Tamil Nadu Government has also replaced The Tamil Nadu Shops & Establishment (Amendment) Act 2018 with Tamil Nadu Shops & Establishment (Amendment) Act, 2021.
As per the new provision, the inspector on receipt of the application in the prescribed manner has to register the establishment and issue the registration certificate to the employer within twenty four hours of the receipt. If the registration certificate is not issued within a period of twenty hours from the date of receipt of application by the inspector, the registration certificate shall be deemed to have been granted under this Act.
The employer shall give intimation to the inspector, in case of any amendment, through the particulars furnished in the application form under sub-section (2), within a period of thirty days of such change. The inspector shall, on receipt of such intimation, amend the registration certificate or issue a fresh registration certificate.
The employer shall, within a period of thirty days of the closure of the establishment, give intimation of such closure to the inspector and on receipt of such intimation, he shall cancel the registration certificate:
The provision for renewal of the registration certificate has been cancelled and there is no any need to renew the registration certificate. The Bill seeks to give effect to the above decision.

Guidelines for Payment of Bonus

The West Bengal Government, vide its circular No. Labr/1690/(LC-IR) /22013 /56/2019, dated 15th September 2021, has published some guidelines and made an appeal to all the employers and employees of the state covered under the Payment of Bonus Act, 1965 as amended by Payment of Bonus (Amendment) Act, 2015 to stick to the specified guidelines while settling the legitimate dues to workers in respect of bonus, in view of ensuing Durga Puja, for the year 2020-21 in the interest of maintaining Industrial peace and harmony in the State. The Government has also asked all the employers to settle the payment before Durga Puja 2021 (i.e. before 7th October 2021).

Though it is an appeal, it acts as an instruction provided to employers routinely every year.

The Haryana Government, vide its notification No. 02/08/2021-2 Lab, dated 16th September 2021, has published its Draft Rules on “Code on Wages (Haryana) Rules, 2021.” This draft Rules will be taken into consideration through the official gazette on or after the expiry of forty-five (45) days from the date of publication of this notification.

Any objections or suggestions may be addressed to Labour Commissioner, Haryana, 30 Bays Building, Sector-17 B, Chandigarh or by email at: codeonwageshry@gmail.com by. The objections and suggestions should be sent in a proforma containing columns:

· Column (i) specifying the name and address of the person/ organization,
· Column (ii) specifying the rule or sub-rule which is proposed to be modified
· Column (iii) specifying the revised rule or sub-rule proposed to be substituted and reasons thereof.

West Bengal

Shops & Establishment Act

The West Bengal Government, vide notification No. Labr/1677/(LC-IR)/IR/7S-06/17, dated 13th September 2021, through the power conferred by Sub-Section (2) of Section 4, has granted Exemption from the opening and closing hours for Petrol & Diesel Filling pumps/ stations as per Section 6 under the West Bengal Shops & Establishment Act, 1963, situated within the areas of concerned assembly constituencies in the state, due to the elections of W.B. Legislative Assembly from 56-Samserganj, 58-Jangipur Assembly Constituencies and Bye-election of W.B. Legislative Assembly from 159-Bhabanipur Assembly Constituencies to be held on 30th September 2021.

However, any work done beyond eight and half hours a day or forty eight hours a week shall be regarded as overtime wages for payment of overtime wages as per the Act.
