Revised Minimum Wages

The Government of Assam, vide corrigendum No. ACL/41/2004/10998 and ACL/41/2004/10991, dated 16th December, 2021, has revised the minimum wages with effect from 1st January, 2021 and 1st July, 2021 as below:

ESI Provisions

Assam ESI Provisions The Central Government, vide notification No.S.O.5371(E), with effect from 1st January, 2022, made the following provisions of the ESIC Act, 1948, applicable in all the areas of Barpeta, Bongaigaon, Bishwanath, Cachar, Chirang, Darrang, Dhemaji, Dhubri, Golaghat, Goalpara, Lakhimpur, Majuli, Nalbari, Marigaon, Nagaon, Sibsagar, Udalguri, West Karbi Anglong (in addition to the already implemented areas in the district), Karbi Anglong, Karimganj, South Salmara Mankachar districts of Assam.
• Sec 38 - All employees to be insured.

• Sec 39, 40, 41, 42, 43 - Regarding payment of employees’ and employer’s contributions.

• Sec 45A to 45H - Determination of contribution in certain case, Appellate authority, recovery of contributions, procedure for recovery, Application of certain provisions of the Income Tax Act.

• Sec 46 to 73 - Benefits, employer not to dismiss or punish employee during the period of sickness.

• Sec 74, 75, sub-section (2) to (4) of Section 76, 80, 82 & 83 - Constitution of Employees’ Insurance Court, matter to be decided by the Insurance Court, proceedings, Appeal, etc.

Assam Professions, Trades, Callings and Employment Taxations (Amendment) Act, 2021

The Government of Assam, vide notification No.- LGL.55/2005/46, dated 16th September 2021, has made some amendments in the Assam Professions, Trades, Callings, and Employment Taxations Act, 1947. Some of the important amendments are as below:
• The explanation for the term ‘Armed Forces’ which is mentioned in Section 3 has been Inserted, which says – The members of the Armed forces of India in the second proviso of Section 3 means the persons who are subject to the Army Act, 1950: the Navy Act, 1957 or the Air Force Act, 1950; and are serving/posted in any part of the State of Assam.

• After Section 5A, Section 5B has been Inserted which says – Any person or Employer who is already registered under the Assam Goods and Service Tax Act, 2017; Assam Value Added Tax Act, 2003; Assam Taxation (on Specified Lands) Act, 1990; the Assam Agricultural Income Tax Act, 1939 and the Assam Electricity Duty Act, 1964; shall be deemed to have been registered or enrolled as the case maybe under this Act and such person or employer shall be liable to make the payment of tax and also liable to furnish return as per provisions of this Act.

• Under sub-section 3 of Section 7, in place of penal provision of Rs. 5 /- for each day of delay for not filing the return, new provision “Rupees one hundred for each day of delay or maximum of rupees five thousand only, whichever is less” shall be substituted.

• After Section 18, Section 18A and 18B has been inserted in which 18A says about the Applicability of the Provisions of the Assam Value Added Tax Act, 2003. 18B speaks about Automated data processing, Applicability of Information and Technology Act, 2000, digital signature, electronic records, electronic governance, digital signature, e-filing, e-return, e-payment etc.

The Government of Assam, vide notification No. GAG(A).81/2016/749, dated 28th October, 2021, has published Holiday List for the year 2022.

Extension of ESIC provisions in certain parts of Assam

As per the Central Government notification No. S.O. 3964(E), dated 24th September 2021, the following provisions of the Employees’ State Insurance Act, 1948, in addition to the provisions which are already there in force, will come into effect in the entire areas of Baksa, Charaideo, Dima Hasao, Hailakandi, Hojai, and Kokrajhar districts in the State of Assam with effect from 1st October 2021, in addition to the already implemented area in the district. The following provisions have been added:

• Entire Chapter IV of the ESIC Act, 1948, which speaks about Contributions. However, Sections 44 and 45 of the same Chapter are already implemented by earlier notification.
• Entire Chapter V which speaks about Benefits.
• Chapter VI which speaks about adjudication of disputes and claims. However sub-section (1) of section 76 and sections 77, 78, 79, and 81 of the same Chapter are implemented by earlier notification.

Minimum wages

Assam Government, vide its notification No. GLR.503/81/Pt-II/8, dated 18th August 2021, has revised VDA (Variable Dearness Allowance) for various scheduled employment listed in the attached Notification with effect from 1st June 2021.

Auto-Renewal Scheme

The Government of Assam, vide notification no. GLR. 65/2019/47, dated 12th January, 2021, has introduced an auto-renewal scheme for certificates of registration and licenses under the following Acts:
(1) The Contract Labour (Regulation and Abolition) Act, 1970
(2) The Assam Shops And Establishments Act 1971
(3) The Inter-state Migrant Workmen (RE&CS) Act 1979
(4) The Factories Act, 1948.
The Labour Welfare department will issue a renewed certificate on receipt of the online renewal applications with a copy of the registered license, renewal fees, and a self-declaration. The same procedure will be followed for amendments as well.

Holiday

The Government of Assam, vide Notification No.GAGA.139/2015/230, has declared 17th December 2020. as a public holiday within the jurisdiction of Tiwa Autonomous Council Area Districts on account of election to the General Council of Tiwa Autonomous Council, 2020. All the Government/Non-Government offices, PRIs, Urban Local Bodies & Business Establishments including Banks, Tea Gardens and Industries, etc. within the specified jurisdiction will remain closed on the day of the poll.
