Minimum Wages Revision

The Government of Goa, vide notification No- CLE/PA/MWA-VDA/(10)/2016/3004, dated 20th October, 2022, has revised the minimum wages for various scheduled employment with effective from 1st October, 2022 as below:

Holiday list for 2023

The Government of Goa, vide notification No. 37/3/2022-GAD-III/3661, dated 19th October, 2022, has published the Holiday List for 2023.
• Holidays for Government offices are specified in Annexure I, II, and III.
• Holidays for Commercial and Industrial workers are specified in Annexure IV.
• Holidays under Negotiable Instruments Act, 1881 are specified in Annexure V.

Draft Rules on Code on Industrial Relation Rules, 2021

The Government of Goa, vide notification No. - 24/19/2021-LAB, dated 21st October 2021, has published the Draft on Industrial Relation (Goa) Rules, 2021. These draft rules will be taken into consideration after the expiry of thirty days from the date of its publication. Any objection(s) and suggestion(s) to the said draft may be forwarded to the Secretary (Labour), Secretariat, Porvium, Goa.

Draft Rules on Social Security Rules, 2021

The Government of Goa, vide notification No.- 24/20/2021/Lab/564, dated 25th November 2021, has published the Draft Rule on Goa Social Security Rules, 2021. These Draft rules will be taken into consideration after the expiry of forty-five days from the date of its publication. Any objection(s) and suggestion(s) to the said Rule may be forwarded to The Secretary (Labour), Secretariat, Porvorim, Goa.

Shops and Establishments Act

The Government of Goa including Daman and Diu, vide notification No. 7/31/2021-LA, dated 24th September 2021, has passed bill and proposed following amendments published for the general information of the public under the Goa Shops and Establishments Act, 1973.

• In the Definition of “Employee” which includes dependent relative of an employer or his partner, who is living with and depending upon such employer or partner” shall be omitted.

• The Inspector shall, within the period of seven working days from the date of receipt of the application and the fees, have to register/renew the registration of the Establishment, and an electronic certificate of renewal shall be auto-generated.

• If the Inspector fails to register or renew the registration of the Establishment within seven days, such establishment shall be deemed to have been registered / renewed under this Act.

• If the application for renewal of Registration Certificate is not made 30 days before its expiry, the employer may have to pay the penalty not exceeding 25 percent of the registration fees.

• Bank or the financial institution can apply for Registration Certificate for more than a year.

• Women employees can be allowed to work in night after providing adequate facilities and protection to the women employees.

• Provisions have been made to keep all the Registers and Forms in electronic format, but should be produced in hard copy to the Inspector on his demand.

• For the applicability of the provisions of the Act, the salary threshold limit of an employee under any establishments under Section 61, has been enhanced from Rs. 6,500/- to Rs. 24, 000/-.

The penal provisions have been amended as per the violation up to Rs. 50,000/- followed by the compounding of offenses.

Code on Wages Rules

The Government of Goa, vide notification No. 24/16/2021-LAB/444, dated 23rd September 2021, has notified its Draft Rule on The Goa Code on Wages Rules, 2021. Draft of the said rules will be taken into consideration by the government on the expiry of 45 days from the date of publication of this Notification. All objections and suggestions, if any, may be addressed to the Secretary (Labour), Government of Goa, Secretariat, Porvorim.

Auto-Renewal of Registration & Licenses

Goa permits Auto-renewal of registration & licensing process under various labour laws as listed below. Government of Goa vide Notification No. 24/27/2020/LAB/1110, dated: 17th Dec. 2020, has introduced auto-renewal systems for Certificates / Registrations / License upon prescribed online payment of fees under the followings Acts for Goa & Daman & Diu:

(a) Registrations under the Goa, Daman and Diu Shops and Establishments Act, 1973 and the Goa, Daman and Diu Shops and Establishments Rules, 1975.
(b) License under the Contract Labour (Regulation and Abolition) Act, 1970 and the Goa, Daman, and Diu Contract Labour (Regulation and Abolition) Rules, 1972.
(c) License under the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 and the Goa, Daman and Diu Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Rules, 1982 The said auto renewal is subject to conditions as prescribed in the said notification.
