Amendment of Shops and Establishments Act

The Government of Tamil Nadu, vide notification dated 19th May, 2023, has amended the Tamil Nadu Shops and Establishments Act, 1947. It has inserted section 22-B, 22-C, 22-D, and 22-E after section 22-A, in the said Act. This newly added provisions make an employer responsible for providing wholesome drinking water, latrine and urinals, rest room and lunch room, first aid facilities to their employees.

The notification further amended the Tamil Nadu Shops and Establishments (Amendment) Act, 2018. Some of salient features of the amendment are as below:
• Every establishment employing ten or more workers shall, within a period of six months from the date of commencement of his business, apply for registration and obtain a registration certificate.
• The Inspector, on receipt of an application, shall register the establishment and issue a registration certificate to the employer within twenty four hours.
• If the registration certificate is not issued within a period of twenty four hours from the date of receipt of application by the Inspector, the registration certificate shall be deemed to have been granted.
• The registration certificate shall be prominently displayed in the establishment by the employer.
• If there are any changes in the particulars furnished in the application for registration, employer has to give intimation about the same, along with prescribed fees to the inspector within 30 days of such change in order to get the amended or fresh registration certificate.
• Intimation about the closure of an establishment should be given within 30 days of such closure to the inspector.
• The employer of every existing establishment employing ten or more workers on the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018, shall furnish the details of the establishment along with a self-declaration to the Inspector, within a period of one year from the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018. The Inspector shall, after recording the intimation furnished by the employer in the Register of the establishments, issue a registration certificate.

Even though the above notification is published by the Government, there is no clarity with regard to effective date of Tamil Nadu Shops and Establishments (Amendment) Act, 2018. Hence, we are expecting another circular from the Government on the effective date and on online implementation of the above said provisions.

Enforcement of ESI provisions

The Central Government, vide notification No. S.O 1427(E), dated, 24th March, 2023, will be implementing following provisions of Employees’ State Insurance Act, 1948, in all the areas of Kanchipuram, Tirupattur, Tiruvannamalai, Viluppuram and Kallakurichi districts in addition to the already notified areas of the said district, in the state of Tamil Nadu, effective from 1st April, 2023.,
· Sections 38 (All applicable employees to be insured)
· Section 39 (All applicable members to Contribute)
· Section 40 (Principal employer to pay contributions in the first instance)
· Section 41 (Recovery of contributions to be done by the immediate employer)
· Section 42 (General provisions as to payment of contributions to be followed)
· Section 4 (Method of payment of contributions to be followed for all applicable members)
· Section 45A to 45H (Determination of contributions in certain cases, appellate authority, recovery of contributions, issue of certificate to the recovery officer, recovery officer to whom certificate is to be forwarded, validity of certificate and amendment thereof, Stay of proceedings under certificate and amendment or withdrawal thereof, other mode of recovery, application of certain provisions of the Income Tax Act)
· Section 46 (Benefits) to Section 73 (Employer not to dismiss or punish employee during period of sickness, etc.) of Chapter V; and Section 74 (Constitution of Employees’ Insurance Court)
· Section 75 (Matters to be decided by the Employees’ Insurance Court)
· Sub-sections (2) to (4) of section 76 (Institution of proceedings, etc.),section 80 (Benefits are not admissible unless claimed in time), section 82 (Appeal) and section 83 (Stay of payment for pending appeal) of Chapter VI.

Minimum Wages revision

The Government of Tamil Nadu, vide notification No.Z3/4023/2023, dated, 27th February, 2023, has revised the minimum wages for all the scheduled employment, effective from 1st April, 2023.

The Dearness Allowances payable per month has been revised to Rs.5,087 from the existing rate of Rs.4,698 for Shops and Commercial Establishments. All Shops and Commercial Establishments are advised to revise the DA payable to their employees from Rs.4,698 per month to Rs.5,087 per month, effective from 1st April 2023.

Election Holiday in Erode

The bye-election to the Tamil Nadu Legislative Assembly from 98 Erode (East) Assembly Constituency is scheduled to be held on 27th February 2023 (Monday). On account of the said election, the Government of Tamil Nadu, vide notification No- G.O.(Ms) No.110, dated 9th February 2023, has declared public holiday on the said polling day for all the employees working in Erode and neighbouring districts, who are eligible for voting for the said election.

Labour Welfare Fund contribution rate revised

The Government of Tamil Nadu, vide notification No. G.O.(Ms) No.161, dated 2nd December, 2022, has revised the rate of contribution under Section 11A of the Tamil Nadu Labour Welfare Fund Rules, 1973.

The new rate of contribution which should be paid yearly is:
• Employee Contribution – Rs. 20/-
• Employer Contribution – Rs. 40/-
• Total Contribution – Rs 60/-

Implementation of ESI provisions in Nagapattinam

Automobile Manufacturing Industry as Public Utility Service

The Tamil Nadu Government, vide notification No. G.O.(Rt) No.370, dated 2nd November 2021, has declared “Automobile Manufacturing Industry” as public utility service under the Industrial Disputes Act, 1947 for a period of six months with effect from the date of publication of this notification.

The definition of public utility service is defined under Section 2 (n) of The Industrial Disputes Act, 1947.

ESIC Provisions in Coimbatore and Thanjavur

The Central Government, vide notification No. S.O.4526(E), dated 29th October 2021, with effect from 1st November 2021, has made the following provisions of the ESIC Act, 1948 applicable in all the areas of Coimbatore and Thanjavur districts in the State of Tamil Nadu.

• Section 38- All employees to be insured.
• Sections 39, 40, 41, 42, 43- Regarding payment of employee and employer contributions.
• Sections 45A to 45H- Determination of contribution in certain case, appellate authority, recovery of contributions, procedure for recovery, and application of certain provisions of the Income Tax Act.
• Sections 46 to 73- Benefits, employer not to dismiss or punish employee during period of sickness.
• Sections 74, 75, sub-sections (2) to (4) of Section 76, 80, 82 and 83- Constitution of Employees’ Insurance Court, matter to be decided by the Insurance Court, proceedings, appeal, etc.

Labour Welfare Fund Act, 1972

The Tamil Nadu Government, vide Notification No. 455, dated 1st October 2021, has amended the Tamil Nadu Labour Welfare Fund Act, 1972, to enhance the yearly contributions to be paid to the Labour Welfare Fund by amending sub Section (1) of Section 15 of The Tamil Nadu Labour Welfare Fund Act, 1972.

As per the new provision, every employee shall contribute a sum not exceeding 50 rupees per year, as may be prescribed, from time to time, to the Labour Welfare Fund and every employer shall in respect of each such employee, contribute a sum not exceeding 100 rupees per year, as may be prescribed, from time to time, to the Labour Welfare Fund and the Government shall, in respect of each such employee, contribute a sum not exceeding 50 rupees per year, as may be prescribed, from time to time, to the Labour Welfare Fund.

Earlier, the said contributions were Rs. 10, 20, and 10 respectively.

Election Holiday

The Tamil Nadu Government, vide Order NO G.O. (Ms) No.121, dated 28th September 2021, has declared 6th October 2021 (Wednesday) and 9th October 2021 (Saturday) as paid holidays to every person employed in any business, trade, industrial undertaking or any other establishments who are entitled to cast vote in their respective Rural Local Body election.

The election will take place in two phases on 6th and 9th of October 2021 in nine newly reconstituted districts - Kancheepuram, Chengalpattu, Vellore, Ranipet, Tirupathur, Villupuram, Kallakuruchi, Tirunelveli, and Tenkasi. Also, Casual Election will be held in 28 other districts on 9th October 2021.

This Rule may not apply to any elector whose absence may cause danger or substantial loss in respect of employment in which he is engaged.

Labour Welfare Fund Act

A Bill further to Amend and Enhancement of LWF contributions.
The Tamil Nadu Government, vide its notification No. 399, dated 6th September 2021, introduced a Bill called the Tamil Nadu Labour Welfare Fund (Amendment) Act, 2021, where amendment has been proposed to enhance the yearly contributions to be paid to the Tamil Nadu Labour Welfare Fund by amending sub-section (1) of Section 15 of The Tamil Nadu Labour Welfare Fund Act, 1972. As per the new provision, every employee shall contribute a sum not exceeding fifty rupees (50 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund and every employer shall in respect of each such employee, contribute a sum not exceeding hundred rupees (100 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund and the Government shall, in respect of each such employee, contribute a sum not exceeding fifty rupees (50 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund.”
Earlier the said contributions were Rs.10, 20, and 10 respectively. The Bill seeks to give effect to the above decision.

Shops & Establishments Act

A Bill on Amendment of Tamil Nadu Shops & Establishments Act. The Tamil Nadu Government, vide its notification No. 399, dated 6th September 2021, introduced a Bill called the Tamil Nadu Shops and Establishments (Amendment) Act, 2021 which has made certain amendments to the Tamil Nadu Shops & Establishment Act 1947.
After Section 22 of the Act, Section 22-A has been inserted, which makes it mandatory for all the employers to provide seating arrangements to all the employees to help them sit, which may require in the course of their work.
It was proposed earlier though not operationally initiated, on and from the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018, the employer of every establishment employing ten or more workers shall, within a period of six months from the date of commencement of his business, apply for registration and obtain a registration certificate, same to be initiated, and the Tamil Nadu Government has also replaced The Tamil Nadu Shops & Establishment (Amendment) Act 2018 with Tamil Nadu Shops & Establishment (Amendment) Act, 2021.
As per the new provision, the inspector on receipt of the application in the prescribed manner has to register the establishment and issue the registration certificate to the employer within twenty four hours of the receipt. If the registration certificate is not issued within a period of twenty hours from the date of receipt of application by the inspector, the registration certificate shall be deemed to have been granted under this Act.
The employer shall give intimation to the inspector, in case of any amendment, through the particulars furnished in the application form under sub-section (2), within a period of thirty days of such change. The inspector shall, on receipt of such intimation, amend the registration certificate or issue a fresh registration certificate.
The employer shall, within a period of thirty days of the closure of the establishment, give intimation of such closure to the inspector and on receipt of such intimation, he shall cancel the registration certificate:
The provision for renewal of the registration certificate has been cancelled and there is no any need to renew the registration certificate. The Bill seeks to give effect to the above decision.

Employees’ State Insurance Act, 1948

The Central Government, vide notification No. S.O.3528(E), dated, 31st August 2021, has notified 1st September 2021 as the effective date on which certain provisions of the said act will come into force in the entire area of Mayiladuthurai, Vellore, and Ariyalur districts in the State of Tamil Nadu, in addition to the already implemented area in the district.

Extension Of ESIC Medical Benefit in Madurai

Employees’ State Insurance Corporation by its Notification No. N-15/13/14/4/2015, dated 3rd August 2021, has extended its medical benefits to the families of Insured persons in the entire area of Madurai district in Tamil Nadu with effect from 1st August, 2021.

ESIC Provisions

ESIC Provisions will be implemented in all the areas of Madurai: The Central Government vide notification no. S.O. 2983(E), dated 28th July 2021 has appointed the 1st day of August, 2021, as the date on which the sections 38, 39, 40, 41, 42, 43 and sections 45A to 45H of Chapter IV; sections 46 to 73 of Chapter V; and sections 74, 75, sub-sections (2) to (4) of sections 76, 80, 82 and 83 of Chapter VI; of Employees’ State Insurance Act, 1948 shall come into force in all the areas of Madurai district in the State of Tamil Nadu. These sections provide that all employees in factories or establishments to which this Act applies shall be insured. The principal employer shall pay in respect of every employee (whether directly employed by him or through an immediate employer), both the employer’s contribution and the employee’s contributions. If any contribution payable under this Act is not paid by the principal employer on the date on which such contribution has become due, he shall be liable to pay simple interest at the rate of twelve percent per annum or at such higher rate as may be specified in the regulations till the date of its actual payment.

Renewal of approved licenses

The Government of Tamil Nadu, vide notification no. TN G0 33, dated 1st June 2021, through the MSME department, has extended the period of renewal of various approved licenses - PCB, Factory, CLRA, ISMW, Legal Metrology, FSSI, Trade Fire & Rescue Services Licenses, etc. The period of approved operation is extended up to 31st December 2021, if they are due to expire between 1st May 2021 and 30th September 2021.

ESIC services coverage extended

ESIC, vide notification no. S.O. 2068(E), dated 28th May 2021, has extended the ESIC service effective from the 1st day of June 2021 for the entire area of Erode District in the State of Tamil Nadu, in addition to the already implemented area in the said District.
This is in continuation to the ESIC endeavor to enlarge the coverage areas and provide benefits to members who were not earlier covered under this scheme.

Shops and Establishments Rules

The Government of Tamil Nadu, vide G.O. Ms. No. 7 dated 11th January, 2021, has issued a draft notification amending the Tamil Nadu Shops and Establishments Rules, 1948. The proposed significant changes are as follows: (A) sub-rules (4) and (5) of rule 11 shall be omitted; i.e. 1 (4) Every employer shall maintain a Register of Fines, deductions for Damages or Loss and Advances in Form P provided that the signature or thumb-impression of the person employed shall be obtained in [Form P] immediately on the working day following the last day of the concerned month.

Every employer shall maintain a register of wages in [Form R] in his establishment.

(B) in rule 16, for sub-rule (1), the following sub-rule shall be substituted, namely:-
(1) (a) Every employer shall maintain.
(i) a Register of persons employed in Form -U
(ii) a Register of Employment in Form -V
(iii) a Register of Wages in Form-W
(iv) a Register of Leave and Social Security Benefits in Form -X
(b) The registers referred to in clause (a) shall be maintained either electronically or manually.
(c) Where the registers referred to in clause (a) are maintained in electronic form, the layout and presentation of the registers may be adjusted without changing the integrity, serial number, and contents of the columns of the registers.
(3) Forms ‘P’,Q’ and ‘C’ shall be omitted.

Public Holiday On 25th November, 2020, Due to Cyclone

The Government of Tamil Nadu, vide Government order G.O. Ms. No. 596, dated 24th November 2020, has declared a public holiday under the Negotiable Instrument Act, 1881 for all Government offices, including the office of the local body, due to forecasted landfall in the coastal areas due to Cyclone 'Nivar' in Tamil Nadu State. The Chief Minister has announced public holiday in the coastal region. The Labour department has not issued any such notification, hence establishments may grant holiday and allow employees to work on any weekly off as compensatory for the cyclone leave.
