Amendment of Shops and Establishments Act
• Every establishment employing ten or more workers shall, within a period of six months from the date of commencement of his business, apply for registration and obtain a registration certificate.
• The Inspector, on receipt of an application, shall register the establishment and issue a registration certificate to the employer within twenty four hours.
• If the registration certificate is not issued within a period of twenty four hours from the date of receipt of application by the Inspector, the registration certificate shall be deemed to have been granted.
• The registration certificate shall be prominently displayed in the establishment by the employer.
• If there are any changes in the particulars furnished in the application for registration, employer has to give intimation about the same, along with prescribed fees to the inspector within 30 days of such change in order to get the amended or fresh registration certificate.
• Intimation about the closure of an establishment should be given within 30 days of such closure to the inspector.
• The employer of every existing establishment employing ten or more workers on the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018, shall furnish the details of the establishment along with a self-declaration to the Inspector, within a period of one year from the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018. The Inspector shall, after recording the intimation furnished by the employer in the Register of the establishments, issue a registration certificate. Even though the above notification is published by the Government, there is no clarity with regard to effective date of Tamil Nadu Shops and Establishments (Amendment) Act, 2018. Hence, we are expecting another circular from the Government on the effective date and on online implementation of the above said provisions.

Labour Welfare Fund Act
The Tamil Nadu Government, vide its notification No. 399, dated 6th September 2021, introduced a Bill called the Tamil Nadu Labour Welfare Fund (Amendment) Act, 2021, where amendment has been proposed to enhance the yearly contributions to be paid to the Tamil Nadu Labour Welfare Fund by amending sub-section (1) of Section 15 of The Tamil Nadu Labour Welfare Fund Act, 1972. As per the new provision, every employee shall contribute a sum not exceeding fifty rupees (50 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund and every employer shall in respect of each such employee, contribute a sum not exceeding hundred rupees (100 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund and the Government shall, in respect of each such employee, contribute a sum not exceeding fifty rupees (50 INR) per year, as may be prescribed, from time to time, to the Labour Welfare Fund.”
Earlier the said contributions were Rs.10, 20, and 10 respectively. The Bill seeks to give effect to the above decision.

Shops & Establishments Act
After Section 22 of the Act, Section 22-A has been inserted, which makes it mandatory for all the employers to provide seating arrangements to all the employees to help them sit, which may require in the course of their work.
It was proposed earlier though not operationally initiated, on and from the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018, the employer of every establishment employing ten or more workers shall, within a period of six months from the date of commencement of his business, apply for registration and obtain a registration certificate, same to be initiated, and the Tamil Nadu Government has also replaced The Tamil Nadu Shops & Establishment (Amendment) Act 2018 with Tamil Nadu Shops & Establishment (Amendment) Act, 2021.
As per the new provision, the inspector on receipt of the application in the prescribed manner has to register the establishment and issue the registration certificate to the employer within twenty four hours of the receipt. If the registration certificate is not issued within a period of twenty hours from the date of receipt of application by the inspector, the registration certificate shall be deemed to have been granted under this Act.
The employer shall give intimation to the inspector, in case of any amendment, through the particulars furnished in the application form under sub-section (2), within a period of thirty days of such change. The inspector shall, on receipt of such intimation, amend the registration certificate or issue a fresh registration certificate.
The employer shall, within a period of thirty days of the closure of the establishment, give intimation of such closure to the inspector and on receipt of such intimation, he shall cancel the registration certificate:
The provision for renewal of the registration certificate has been cancelled and there is no any need to renew the registration certificate. The Bill seeks to give effect to the above decision.

Shops and Establishments Rules
Every employer shall maintain a register of wages in [Form R] in his establishment.
(B) in rule 16, for sub-rule (1), the following sub-rule shall be substituted, namely:-
(1) (a) Every employer shall maintain.
(i) a Register of persons employed in Form -U
(ii) a Register of Employment in Form -V
(iii) a Register of Wages in Form-W
(iv) a Register of Leave and Social Security Benefits in Form -X
(b) The registers referred to in clause (a) shall be maintained either electronically or manually.
(c) Where the registers referred to in clause (a) are maintained in electronic form, the layout and presentation of the registers may be adjusted without changing the integrity, serial number, and contents of the columns of the registers.
(3) Forms ‘P’,Q’ and ‘C’ shall be omitted.
