Election holiday

The Government of Telangana, vide notification No. G.O.Rt.No.504, dated 31st October, 2022, has declared public holiday for all the employees, working in any Industrial undertakings and Shops and Establishments, who are entitled to vote in the area of 93-Munugode Assembly Constituency, Nalgonda, and Yadadri Bhuvanagiri district on 3rd November, 2022 (Thursday) on account of bye-elections for the said areas, to be held on the said date.

Industrial undertakings or Shops and Establishments which are working on shift basis can declare holiday only for the shift during which the polling is taking place.

Deepavali holiday

The Government of Telangana, vide notification No. G.O.Rt.No.1976, dated 19th October, 2022, has declared 24th October, 2022 (Monday) as General Holiday instead of 25th October, 2022 on account of Deepavali under the Negotiable Instruments Act, 1881.

Earlier the Government of Telangana, vide order No. G.O.Rt.No.2619, G.A.(SPL.E) Dept, dated 26th November, 2021, had declared 25th October, 2022 as holiday on account of Deepavali.

Conditions for employing women in night shift in establishments

The Government of Telangana, vide notification No. G.O.Rt.No.476, dated 13th October, 2022, has allowed all establishments in Telangana to employ women between 8:30 pm to 6:00 am, subject to certain terms and conditions specified in the notification.

If any establishment fails to comply with the specified conditions, it may lead to cancellation of the Registration Certificate and/or withdrawal of the said exemption granted in respect of such establishment.

The office of the Joint Commissioner of Labour, Rangareddy Zone, vide notification No. Proc.No.F/1019/2021, dated 6th December, 2021 has published the notification on Holidays List for 2022 for the employees employed in Factories and Shops & Establishments located in Rengareddy zone, Medchal, Vikarabad, Medak, Siddipet, Sangareddy, Nizamabad, Kamareddy, Nalgonda, Yadadri, Suryapet, Mahabubnagar, Nagarkurnool, Wanaparthy, Jogulamba Gadwal, and Narayanpet Districts.

Draft Rule on Industrial Relations Rules

The Telangana Government, vide notification No. G.R. Rt. No. 479, dated 29th September 2021, has published its Draft Rule on Industrial Relation (Telangana State) Rules, 2021. The draft will be taken in to consideration after the period of 30 days from the date of its publication.

Any objections and suggestions may be addressed to the Commissioner of Labour, T. Anjaiah Bhavan, RTC ‘X’ Roads, Hyderabad, Telangana, by post or through email: col.labour.telangana@gmail.com & jcl.ts.hq@gmail.com. It may be sent in a pro-forma containing columns

(i) specifying the name and address of the person / organization and column
(ii) specifying the rule or sub-rule which is proposed to be modified and column
(iii) specifying the revised rule or sub-rule proposed to be substituted and reasons thereof.

The Government of Telangana, vide notification No. G.O. Rt. No. 480, dated 29th September 2021, has published its Draft Rule on Telangana Code on Wages Rules, 2021. The draft will be taken into consideration after the period of 45 days from the date of its publication.

Factories Rules Concerning Asbestos

The Government of Telangana, vide Notification No. G.O.Rt.No.449, dated, 7th September 2021, has published Draft Rule for Amending the Telangana Factories Rules, 1950 concerning Asbestos. This Rule will be taken into consideration by the Government after the expiry of 45 days from the date of publication of the attached notification. Declaration of Optional Holiday and General Holiday on Account of Moharram

The Telangana Government by its Order No. G.O.Rt.No.1827, dated 17th August 2021, has declared an Optional Holiday on 19th August 2021, (Thursday) on the occasion of ‘the 9th day of Moharram’ instead of 18th August 2021 (Wednesday). It has also declared a General Holiday on 20th August 2021 (Friday) on account of ‘the 10th day of Moharram’ instead of 19th August 2021 (Thursday).

Extension of Due Date

The Government of Telangana vide notification no. 104, dated 7th May, 2021, has extended the due date for furnishing integrated returns under various labour laws. The government hereby provided extension of two months i.e till 30th June, 2021, and this will be a one-time relaxation provided due to Covid 19 (2nd wave).

Shops and Establishments Rules

The said alert is in continuation to the Telangana notification number G.O.Rt.No.106, dated 15th February, 2021.

In continuation to the alert on Ease of Doing Business of Telangana, dated 15th February, 2021, under the legislation of Telangana CLRA Rules, Inter-sate Migrant Workmen Rules & Telangana Standing Orders were used. The following changes are proposed under the Telangana CLRA Rules:

The following compliance points may get exempted as part of self-certification process. However, when we approached the Deputy Commissioner & Joint Commissioner, we were informed that the changes not yet been internally circulated. It isn’t evident whether an acknowledgement from the department has to be taken directly, or online. Hence, any changes / direction in rules or formats will be brought to the notice later.
1. Display of Abstract of the Act and Rules in English, Hindi and the language spoken by the majority of people - Exempted
2. Display of notice in English, Hindi and the language spoken by the majority of people - Provided wage and wage period are in conformity with the law.
3. Displaying notice of the wage period and place and time of the disbursement - Provided wage and wage period are in conformity with the law.
4. Annual lime washing or color washing of inside walls of canteen - If cleanness is maintained
5.Four monthly lime washing of Kitchen and walls of canteen - If cleanness is maintained
6. Payment of wages without any deduction - Provide wage in conformity with the law.
7. Presence of authorised representative of the principal employer during the disbursement of the wages - Provided wages are paid through.
8. Preservation of the records and registers for a period of three years. - Provided it is maintained in electronic form.
9. Production of books of accounts and registers and other documents to the inspector - Provided it is maintained in electronic form.
10. Production of the register and records before the inspector or the authority. - Provided it is maintained in electronic form.

The Government of Telangana, vide notification no. G.O.Rt. No.1539, dated 14th October 2020, has declared holiday on 14th and 15th October 2020, for all institutions in the banking sector, i.e Banks & Financial Institutions registered under the Negotiable Instruments Act, 1881. The notification has not specified if the holidays apply to Factories, Shops, and Establishments.

Exemption of periodic renewal of license

Government of Telangana vide notification number G.O.Rt.No. 289 dated 17/09/2020 for Ease of Doing Business has exempted The Inter–State
Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 from periodic renewal of license. The license is deemed to be renewed subject to timely payment of renewal fee and within the prescribed time limit.
