Election Holiday

The general election to all the Assembly Constituencies in Tripura will be held on 16th February 2023. On account of the said election, the Government of Tripura, vide notification No- F.17(4)-GA(SA)/2019/1091-1108, dated 4th February 2023, has declared a paid holiday on the polling date for all the voters working in all establishments and industrial Undertakings coming under the jurisdiction of the constituencies to which election is going to be held. Employees who are registered electors in the said constituencies but posted outside their constituencies, will be allowed to avail of special casual leave to cast their vote.

Draft Rules on Social Security Rules, 2021

The Government of Tripura, vide notification No- F.21(99-02)LAB/ENF/SSC/2021, dated 24th September 2021, has published the Draft on Tripura Code on Social Security Rules, 2021. These Draft rules will be taken into consideration after the expiry of forty-five days from the date of its publication. Any objection(s) and suggestion(s) with respect to the said draft Rules may be sent in duplicate to The Secretary, Labour Department, Government of Tripura, Secretariat, Agartala, Tripura West, 799010 or email to lctripura.agt@gmail.com.

Revised Minimum Wages

The Government of Tripura, vide notification No. F.87(30)-LAB/ENF/MW/SHOPS/ 2002(A)/7066-84, dated 4th December, 2021, has revised minimum wages for all the employees working in Shops & Establishments with effect from 1st October, 2021 as below:

Implementation of ESIC provisions in certain parts of Tripura

The Ministry of Labour and Employment, vide notification No. S.O. 3952(E), dated 23rd September 2021, has notified the following provisions of The Employees’ State Insurance Act, 1948. These provisions shall come into force in all the areas of Dhalai, Gomati, North Tripura, and Sepahijala districts in the State of Tripura with effect from 1st October 2021.

Sections 38 (All applicable employees to be insured)
Section 39 (all applicable members to contribute)
Section 40 (Principal employer to pay contributions in the first instance)
Section 41 (Recovery of contributions to be done by the immediate employer)
Section 42 (General provisions as to payment of contributions to be followed)
Section 43 (Method of payment of contributions to be followed for all applicable members)
Section 45A (Determination of contributions in certain cases to be done)
Section 45H (Application of certain provisions of the Income-Tax Act) of Chapter IV;
Section 46 (Benefits) to Section 73 (Employer not to dismiss or punish employee during period of sickness, etc.) of Chapter V; and
Section 74 (Constitution of Employees’ Insurance Court), section 75 (Matters to be decided by the Employees’ Insurance Court), Sub-sections (2) to (4) of section 76 (Institution of proceedings, etc.),
Section 80 (Benefits are not admissible unless claimed in time),
Section 82 (Appeal)
Section 83 (Stay of payment for pending appeal) of Chapter VI.

Industrial Relations Code Rules, 2021

The Government of Tripura vide notification no. F.21(99-4)- LAB/ENF/IR/2021/1254, dated 16th June 2021, has issued the draft Industrial Relations Code Rules, 2021. The department has invited objections and suggestions on the draft till 30 days from the date of publishing the notification. Code on Wages Rules, 2021

The Government of Tripura vide notification no. F.21(99-01)-LAB/ENF/CWR/2021/904-906, dated 16th June 2021, has issued the draft Tripura Code on Wages Rules, 2021. The department has invited objections and suggestions on the draft till 45 days from the date of publishing the notification. ESIC services coverage extended

ESIC, vide notification No. N-16/2/Tripura/2017-P&D, dated 25th May 2021, has extended medical benefits with effect from 1st April 2021 to the families of all insured persons in the entire area of Khowai, South Tripura and Unakoti districts in the State of Tripura. This is in continuation to the ESIC endeavor to enlarge the coverage areas and provide benefits to members who were not earlier covered under this scheme

Factories Rules

The Government of Tripura, vide notification no. F.7(121)-FB/AM(Vol.-II)/2007/2199-07, dated 27th January, 2021, has amended the Tripura Factories Rules, 2007. The amendments are:
1. Temperature in hygrometer has to be recorded, three times daily during working days at a proportional period of interval by a competent person approved by the inspector.
2. It further mandates the employer to provide personal protective equipment such as safety helmets, protective footwear, safety goggles, and spectacles, equipment for eye and face protection during welding, gloves and protective clothing, ear protection when exposed to noise, respiratory protection, etc. to all workers and the said equipment shall also conform to the relevant national standards.

Shops And Establishments Ordinance

The Government of Tripura, vide notification no.F.8(3)-Law/Leg-I/2021, dated 29th January, 2021, has introduced Tripura Shops and Establishments (Fifth Amendment) Ordinance 2021. As per the notification, the existing provision of registration of shops and establishments has been substituted. Henceforth, establishments only have to obtain trade license for pursuing business from the competent local authority through the department’s online portal - swaagat.tripura.gov.in.
